You agree to be held responsible and liable in case you breach intentionally or unintentionally our property right. Every user who uses our website or services has to register him/her-self as the time of making orders on our website. The personal information which you provide us at the time of registration must be true, accurate, upto date  and complete in every way. You will not provide us any false information which my directly or indirectly harm or offend anyone. You will not impersonate any other person or entity with any direct or indirect means. This applies also when you contact us through our website, or other communication means such as chat, emails and/or call us. 

 

4. Privacy Policy

We never sell or rent your personal information. We treat you personal information as confidential (exceptions can be made please read below). Our services are secure and your information is stored in our databases and encrypted backup storages. In case of unexpected data theft from our servers that may happen only as a result of accident you as a user cannot hold us responsible. 

When you do purchases on this website, we will ask you to provide/input personal contact information, such as your name, telephone number, email address, home address, address for the delivery of the purchased products/services, credit cards and other form of payment information and a password. This personal information is stored under your user profile in our system, once you provide this data to us we will provide you this data when you do shopping with us next time. We do not collect your personal information described above unless you provide it to us voluntarily.

This conditions also apply to the order which you send to us through any other medium of communication(s), including but not limited to telephone, emails, chat, sms etc.. 

 

Product delivered may vary from the picture(s) and/or movie(s) shown on the website: We make every effort to delivery the products exactly in the same format and condition as they are show on our website. However, due to the nature of products and their availability in the market the products delivered to the customers may slightly vary from the Product Description provided on the website. Thus, the product’s textual description, picture(s) and movie(s) are meant to provide you an idea as to how the actual product would look like. The purpose of picture(s) and movie(s) shown on the website is to demonstrate the products they are not meant to act as legal binding between customers and Iconic Tech & Media. This is mainly because, we operate on a national scale and thus, product(s) can have variation(s) depending on the region where it is produced or manufactured. Furthermore, the colors of our products you see on your computing device when you visit our website may differ depending of the color capacity and resolution of your display. 

 

Losses due to ordering with us: we in our capacity take all possible and reasonable measure to keep your order, personal/profile and payment information secure. But if due to the absence or negligence on our part including our employees and third parties involved in but not limited to the payment processing you suffer any loss(es) we cannot be held liable for your loss(es). We are also not accountable in case your data is stole or access by any unauthorized entity. 

 

Establishing Electronic Contract after creation of order(s): Order creation process includes few steps before an electronic contract is established between you as a customer and we. These are the steps of making order followed by the contract creation. a) You choose the product(s) you want to order from our website. When you checkout with your order from our website, you will be presented with few guided steps to confirm your order. Based on the payment method you select the order confirmation may be different. After confirming your order we will send you a acknowledgement that we have received your order, this is however not a confirmation that we have or will process your order. After receiving your order we perform several steps internally and also conduct different validations checks. You order may be rejected or refused, please read below. After we have shipped/delivered your order to its destinations, we will send you a confirmation over the email, at this point it becomes an established electronic contract between you as customer and JinBaba.PK and thus your order is accepted.

 

Order(s) Rejected or refused: Your order may be rejected or refused under these situations.

a) We find that there was a description error due to our mistake on the website. This may include the price that we might have wrote on our website by mistake.

b) You do not comply complete or partially with our terms and condition including those stated here and other stated else where which were accessible to you through our website and services. 

c) The product you have ordered is out of stock. 

d) Your payment is not authorized/confirmed.

 

Fraudulent Orders:

If we conclude that any order is fraudulent for whatever reason, we reserve the right to cancel the order and refund the funds without prior notification. We will not be under any obligations to disclose and reveal the reason(s) why we think that the order is fraudulent. We are free to block the customer’s IP address(es) who we think are fraudulent.

 

 

Order Messages: You as a user can send us order messages. There are two different types of messages, which you can send us. Message type (a) is the message which is an instruction and/or advices which you want us to consider while processing your orders. Message type (b) is the message which we can forward to along with your order, it is intended to let you express your wishes for the receiver of the product; this message will be written on the greeting card which we will deliver along the ordered gifts. As a user of our website you agree that we can change, or delete the message if we find it not complying with our terms and conditions. 

 

Prices and Payments: All prices on our website are intended to be correct at the time making them available on the website. However, as a customer you agree that if you have made an order on our website for which we think that the prices was not correct due to human error; in such cases we reserve the right to ask you to pay the correct price.

 

It is also a precondition for processing the order that the payment is confirmed. As a customer you agree that you understand the difference between the prices for the item(s) and price for the delivery (where applicable). You agree to pay the sum items and the delivery at the time of making the order. There are different payment methods available for your convenience. As a customer you agree and fully understand that different payment methods have different latency. Payment confirmation in certain payment method is immediate, however for some payment methods the confirmation can take longer time. You are free to choose from the available payment methods. We will not be liable for the delay that occurs due to the payment processing. In case you pay through credit/debit card: you confirm that the credit/debit card is yours. All credit/debit cad holders are subject to validation checks and authorization by the card issuer. You agree to authorize us AND THE OTHER ENTITIES INVOLDED IN CREDIT CARD PROCESSING to take all the necessary steps to ensure the safety of your credit/debit card information and also ensure valid and confirm payment. When you place an order through us you give us authority AND THE OTHER ENTITIES INVOLDED IN CREDIT CARD PROCESSING to authorize and/or transmit information and/or obtain information about you form the third party(ies) from time to time. This includes, but not limited to your identity, credit/debit, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions. We may refuse to process any transaction at anytime at our sole discretion. 

High Value Transactions: We may take special precautions for high value transactions and the will only ship after the transition is fully clear. It can take extra time ranging from 2 to 5 working days. We may decide to call the customer and verify the identity. In case we cannot establish the validity and authenticity of the customer we may delay the order until we completely sure that the order is not fraudulent. We may ask you to provide Identity information (e.g. ID card copy or some other government issued ID) in case of high value. In some cases we may ask the receiver to sign the receiving slip upon delivery.

 

Repeat Orders /Returning Customers: if we receive same order more than 4 times in a month or more it may be subject to suspicion and it may require extra validation and approval of our accounts department. In cases where we are not sure about the validity and legitimacy of the placed order we may decide to cancel / Refund the order.

 

Order Complaints: We strive to provide our customers with the best available products in the Pakistani Market. However, if you have received wrong product or the received product faulty and then you much inform us no later than 5 working days. You must do this through our website using you’re my account page. The reference number of the order in question must be available in the complaint along with the recipient information and a digital photograph showing the faulty product at the time of delivery. After we receive the complaint we will investigate the issue and if we find that your complaint is a legitimate we will offer you compensation in the form of refund or replacement. Please note that this does not applies to perishable products.

 

Guaranty claims: If your product is covered by a guaranty then we will provide you with the guaranty card of the product at the time of delivery. It is your responsibility to take care of the guaranty cards/information. We do not keep track of the guaranty. We purchase the products from different suppliers. The Supplier’s information will be available on the guarantee card, incase you need to make any claim regarding the guaranty of the product; you agree to contact the supplier directly. We cannot be held liable for the guaranty of the products in anyway.

 

 

7. Order Returns, Updates, Cancelations and Refund Policy 

 

As a general rule we will not refund the shipping cost which you paid at the time of making order.

 

Refund if the delivery is failed: We will attempt the delivery for any order that is successfully placed in accordance with our terms and conditions. We always call the receiver before we attempt the delivery. If you as a customer have provided us with wrong or incomplete information then we may decide to contact you to get the correct information. However, please note that it is solely up-to us to decide, to get the corrected information from you. It also depends on the season and many other internal factors.

 

Along with others in the following cases we will NOT provide any refund and will not attempt the delivery.

 

·       We have attempted the delivery, but you have provided wrong/incomplete contact information and/or address of the recipient and we have decided not to get the updated address. This especially applies to the perishable items, such as cakes, pizzas, methai etc..

·       The recipient is not available at the address and wants that we deliver at some other time.

·       The receipt wants us to come to some other address, which was not in the original order

·       The recipient has refused to receive the items

·       The recipient is not reachable on the contact information you have provided

 

 

Customers have to place the order again, kindly understand our position.

 

Order Return and Refund Policy – You as customer can return the items we have delivered within 5 working days. Any item that is returned must be in its original packing and unused. The packing must not be tempered for the returned item. Customer has to pay for the return shipping and it the responsibility of the customer to make arrangements for the return. Additionally a 20% of the order price will be deducted as handling charges. Shipping charges you might have paid at the time of placing the order will not be refunded. Returns after 5 working days will not be accepted and there will be no refund. We are not responsible to send you the item again if it is returned late or if you have sent us an item which we think is used or open. In those cases you must collect your item yourself.

 

Return of Customized orders: It is not possible to refund fully or practically the item(s) which is/are prepared according to your personal specifications. As a general rule it is not possible to refund custom/customized orders.

 

 

Order cancelation: If you want to cancel your order before we have dispatched it then we may deduct 15% of your total payment as handling cost.

 

Refund of Perishable items: Orders containing items which fall into following categories cannot be returned or canceled and hence there will be no refund.

 

- Custom made cloths for example dresses, curtains.

- Perishable goods e.g. Flowers, Cakes, Methai

- Other eatable items

 

We will attempt to deliver such orders.

 

Update the order: If you think that you have made an order by mistake and you want to update your order then you must contact us with in 1 hour of making order.

 

 

6. Delivery Policy 

Incomplete addresses: It is your responsibility as a user of our website to provide us complete address for the delivery. You must provide all the address details including but not limited to city, area code, street number, block name/number house number to which you want the delivery to be made. If we cannot locate the address because it was incomplete, inaccurate or misleading, then your delivery can be delayed or in worst case we reserve the right not to deliver at all. There will be no refund in such cases; this is mainly due to the nature of the products we deliver, as they cannot be restocked. 

 

Anonymous Deliveries:  All customer are required to provide us all the information that is need to process the order successfully. This includes but not limited to the sender’s information and the receiver’s information. We will not process the orders which are anonymous in nature. You cannot ask us to delivery the items at vague address. For example you cannot ask us to leave a parcel outside a house of leave it on a road or a local shop, public places etc. We reserve the right to hold/cancel/refund such order without prior notice.

 

Delivery time: You as a customer can ask us to deliver the order on a particular time. However, you as a customer agree and understand that orders can get delayed due to many unexpected circumstances. The weather conditions, law and order situation, traffic conditions are just a few to mention. Therefore, the time of delivery you tell us at the time of placing the order is a target for us that we strive to achieve. If you have selected time specific delivery then you agree and understand that the time you have specified may not be achievable. Although we try our best to delivery the items on time.

 

Midnight deliveries: midnight deliveries are attempted anytime between 11PM to 1:00AM.

 

8. Our rights

 

Indemnity: You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and / or your Personal Information.

 

Modifying, updating, changing or taking this website offline: We reserve the right to: modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and / or Change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change.
